1. Introduction

Welcome to Ternny. These Terms of Service ("Terms") govern your use of our travel social platform and mobile application (the "Service") operated by Ternny ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms in accordance with applicable law, including, where it applies to you, the General Data Protection Regulation (GDPR).

2. Eligibility

You must be at least 16 years old to use this Service. If you are under 18, you confirm that you have obtained parental or guardian consent to use this Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and confidential
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activities under your account

4. User Content

Our Service allows you to post, share, and store content including travel photos, trip details, reviews, comments, profile information, and messages ("User Content"). You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free license to use, host, display, and distribute your content within the Service for the purpose of operating and providing the Service.

You agree not to post or share content that:

Violates any applicable laws or regulations
Infringes the intellectual property rights of others
Contains defamatory, abusive, harassing, or discriminatory material
Includes personal data of others without their consent
Contains malware, spam, or unauthorized advertising
Impersonates another person or entity

5. Objectionable Content & Abusive Behavior: Zero Tolerance

Ternny is a community for travelers. To keep it safe, we have zero tolerance for objectionable content and abusive users.

5.1 Prohibited content and conduct. In addition to Section 4, you agree that you will not create, post, send, or share content, and will not engage in behavior, that:

is harassing, bullying, threatening, or intended to intimidate another person;
is hateful or promotes discrimination, bigotry, or violence against people based on race, ethnicity, national origin, religion, disability, gender, gender identity, age, or sexual orientation;
is sexually explicit, pornographic, or sexualizes minors in any way;
depicts or incites violence, self-harm, or harm to others;
is illegal, promotes illegal activity, or facilitates the sale of illegal or regulated goods;
is spam, fraudulent, deceptive, or a scam;
impersonates another person or misrepresents your affiliation with anyone;
shares another person's private or personal information without consent.

5.2 No tolerance. There is no acceptable level of the content or conduct described above on Ternny. We do not require repeated violations before acting.

5.3 Reporting and blocking. Every user can:

Report objectionable content or another user from within the app (via the "⋯" menu on a profile or in a chat, or by long-pressing a message), and
Block any user, which immediately stops that user from contacting them and hides each user's content from the other.

5.4 Our commitment to act. We review reports of objectionable content and abusive users and act on them within 24 hours of receipt. Action may include removing content, issuing a warning, suspending the account, or permanently banning the user and ejecting them from the Service, at our sole discretion, with or without notice.

5.5 Enforcement. We reserve the right (but are not obligated) to monitor, review, remove, or restrict any User Content, and to suspend or terminate any account, at any time and for any reason, including suspected violation of these Terms. Violations may also be reported to law enforcement where appropriate. User Content reflects the views of the user who created it, not Ternny; we do not endorse and are not responsible for User Content.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

Use the Service in violation of any applicable laws
Attempt to gain unauthorized access to the Service or its systems
Interfere with or disrupt the Service or servers
Use automated means to access the Service without permission
Collect user data without authorization
Engage in harassment, bullying, or intimidation of other users

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which complies with the GDPR and other applicable data protection laws. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

8. Intellectual Property

The Service, including its original content (excluding User Content), features, and functionality, is owned by Ternny and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks may not be used without our prior written consent.

9. Third-Party Services

The Service may integrate with third-party services (e.g., maps and location providers, authentication providers, payment processors). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for third-party content or services.

10. Termination

We may suspend or terminate your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time from within the app's account settings. Upon termination, your right to use the Service will cease immediately, and we will delete your account data in accordance with our Privacy Policy.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. Travel information and recommendations are for informational purposes only and should not be relied upon as professional travel advice.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Ternny shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. This limitation does not affect your statutory rights as a consumer.

13. Consumer Rights

If you are a consumer in the European Union, you benefit from mandatory provisions of consumer protection laws. Nothing in these Terms shall affect your rights under such laws, including the right to withdraw from distance contracts within 14 days where applicable.

14. Dispute Resolution

We encourage you to contact us first at legal@ternny.com to resolve any disputes informally; most issues can be resolved quickly this way. These Terms are governed by the laws of the European Union and the member state where we are established, without regard to conflict-of-law provisions. Nothing in this section limits any mandatory consumer rights available to you under the law of your country of residence.

15. Apple App Store: Additional Terms

These additional terms apply to your use of the Ternny application obtained from the Apple App Store ("App"), and prevail over any conflicting terms above to the extent of the conflict:

Acknowledgement. These Terms are concluded between you and Ternny only, and not with Apple Inc. ("Apple"). Ternny, not Apple, is solely responsible for the App and its content.
Scope of license. The license granted to you for the App is a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
Maintenance and support. Ternny is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
Warranty. Ternny is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Product claims. Ternny, not Apple, is responsible for addressing any claims relating to the App or your use of it, including (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual property. In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, Ternny, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service at least 30 days before changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
